Apple knows how to protect intellectual property rights.

Those who follow our blog have often seen how effective and zealous Apple is when it comes to protecting its intellectual property rights. Moreover, the legal actions taken by the Cupertino-based corporation are often disproportionate to the potential infringements, and sometimes even completely unnecessary. This time, the creators of the Prepear app experienced Apple's overzealousness firsthand.

Apple or pear?

Interestingly, the application itself has nothing to do with Apple’s activities, as it focuses on social media features in relation to nutritional recipes. The program allows users to exchange recipes, create shopping lists, and discover new and individual dishes.

However, it is not so much the application itself, but the Prepear logo depicting a pear that has become the cause of the dispute. According to the company from Cupertino, this fruit is very similar to the bitten apple logo, which allegedly harms the brand. Apple believes that the minimalist depiction of a pear with a leaf is associated with the logos of, among others, the iPhone, which may lead consumers to perceive both companies and trademarks as related entities. As a result, Apple filed an opposition to the registration of the Prepear trademark.

Save the pear

The creator of the app and the disputed graphic design, in response to the objection, announced online that Prepear is a small business and employs only a few people. This is why the creators of the app with the pear logo cannot afford a long-term legal battle with Apple. Taking these circumstances into account, the creators of Prepear launched an online petition titled “Save the Pear from Apple!”, which aims not to discourage people from using Apple products, but to refute the unfounded allegations and show that intimidating small businesses by such large corporations has consequences. The petition has already n signed by over 40,000 people, and Prepear hopes that this time Apple will drop the dispute and withdraw the objection. What will be the reaction of the company from Cupertino? We will find out soon, but given Apple’s past actions (e.g., objecting to the logo of a German cycling path), the outcome may not be favorable for the creators of the “pear.”
