Since then, the situation seemed to have calmed down a bit, but the last few days have shown that Cracovia decided to approach the issue from a different angle. Recently, the Patent Office of Poland granted MKS Cracovia SSA the right to protect the verbal and verbal-graphic trademark “Cracovia, the oldest sports club in Poland.” As a result, it is this team that will be able to use this phrase with the famous “R” in a circle at various events, which will certainly not please the local competition. According to Cracovia officials, the application and registration were merely a formality. However, does this situation indicate that the Patent Office of Poland has recognized that Cracovia is indeed the oldest club? Not necessarily, as in this case, the Office did not examine documents, evidence, or other issues that would determine the date of the football club’s establishment. The focus when granting the right of protection was on the originality of the phrase as a whole and whether it is used by other entities.
Therefore, at this moment, another club with a similar opinion can apply to the Patent Office of the Republic of Poland and register similar slogans for itself. However, it is interesting to note that both Wisła Kraków and Cracovia Kraków were founded in 1906, but according to historians, it is impossible to determine with certainty which club was founded earlier. Cracovia, however, celebrates its anniversaries on June 13, while Wisła Kraków does not have a specific date for this.
