The history of the dispute dates back to October 2021, when Perplexity Solved Solutions, a company from Texas, filed an application to register the trademark “Perplexity.” The company, which has n operating since 2017, received official registration in November 2022. It specializes in creating advanced solutions for HR departments and tools that support collaboration within companies. Their flagship product is the Perplexity Meet video conferencing platform, which has gained recognition among corporate clients. The company also registered the domain perplexityonline.com, which was intended to serve as the basis for their online presence.
The main point of contention is the commencement of operations by the startup Perplexity AI, which, according to the lawsuit, has n illegally using the protected name to promote its AI-powered search engine since August 2022. Particular controversy has n sparked by the launch of the Perplexity Spaces service, which offers functionalities similar to those of the plaintiff. Lawyers for Perplexity Solved Solutions emphasize that the startup’s actions lead to customer confusion and may cause significant reputational and financial losses for their client.
In September 2023, an attempt was made to resolve the dispute amicably. Perplexity Solved Solutions offered the startup the option to buy the rights to the trademark, which could have ended the conflict. However, Perplexity AI rejected this proposal and decided to file its own trademark application.
This decision significantly escalated the dispute between the companies. Furthermore, the startup ignored the request to stop using the disputed name, which led to the conflict escalating into a legal battle.
The case has n brought before the Northern District of California District Court, where it will be considered in terms of violating the Lanham Act, which regulates trademarks and unfair competition in the United States. Perplexity Solved Solutions is not only seeking an injunction against Perplexity AI’s use of the trademark, but also significant damages and the transfer of all domains containing the name Perplexity. Moreover, this is not the only legal problem the startup is facing – the company is simultaneously dealing with a lawsuit from News Corp and NY Post regarding copyright infringement of content. The New York Times has also sent a letter to the startup demanding that it stop using their materials. This accumulation of legal problems may significantly affect the future and development of Perplexity AI, especially in the context of expansion plans and attracting new investors.
