
Recent events, however, have shown that the organizers of Coachella are not resting on their laurels and want to fight for their trademark rights. To this end, on October 5, 2022, The Coachella Music Festival LLC and Goldenvoice filed a lawsuit against the organizers of Afrochella in California court for trademark infringement and unauthorized use. The lawsuit emphasized that there is no connection between the parties or the events they organize. Furthermore, the defendants are taking advantage of the reputation of the Coachella festival and actively promoting their event in Africa, while also attempting to register the plaintiff’s trademarks, namely Coachella and Chella, in Ghana for their own benefit. As such, these actions were deemed unacceptable, and legal action was necessary.
Interestingly, the organizers of the American festival have contacted the defendant several times regarding the adoption of a unique and distinctive name for the African event that would not be similar to the Coachella trademark. Unfortunately, without success.
How the case will end and whether Afrochella will change its name remains to be seen. We will have to wait for the official court decision.
