Since 2010, MetaX LLC has n operating in the market, using the name Meta. Interestingly, in 2016, the company applied to register the trademark “Meta,” which was registered in 2020. There wouldn’t be such a big problem if the company operated in markets different from Mark Zuckerberg’s company – however, it turns out that MetaX mainly operates in the fields of empirical and immersive new technologies, which focuses primarily on VR, AR, and IT – which are nothing more than augmented and virtual reality. It is worth noting that the concept of the metaverse is precisely an attempt to create a virtual world accessible to everyone, based on augmented and virtual reality. Therefore, the activities of both companies undoubtedly overlap.
As a result, without paying attention to the competition, Facebook changed the company’s name and now uses the “Meta” designation in its daily operations. This action prompted the owners of MetaX to file a lawsuit against Meta Platforms, and the case was brought before the District Court in New York.
According to the CEO of MetaX, this is not a case of a mistake, as MetaX was in constant contact with Facebook, and for eight months, the companies corresponded on this matter and its amicable resolution. The lack of agreement led to the necessity of taking the case to court. According to MetaX, the unlawful appropriation of the “Meta” designation constitutes a violation of fundamental intellectual property rights, which are guaranteed by US law.
According to the plaintiff, their small brand has n built over more than 12 years, and now Facebook, with its recent actions, has simply wasted years of hard work and will ultimately lead to the collapse of a company that has n operating for over a decade. Furthermore, the lawsuit alleges toxicity associated with Facebook, and through the use of similar names, it is now also associated with MetaX. As a result, consumers may mistakenly believe that the products and activities of both companies are related. To date, the owner of Facebook has not responded to the filed lawsuit, but given the truly similar activities of both companies, the outcome of this case will be ambiguous, and at the same time interesting in the context of Mark Zuckerberg’s plans. It is highly likely that the case will end with a lucrative settlement.
