In 2022, Transport for London (TfL), the British organization known for the London Underground, applied to register the trademark "MIND THE GAP." Grounds for objection

GAP Inc. opposed the registration of the “MIND THE GAP” trademark by TFL, arguing that it infringes on their GAP brand rights and a prior agreement between the parties. UKIPO Decision

In December 2024, the UK Intellectual Property Office (UKIPO) issued a decision in this case, which attracted the attention of many trademark protection specialists.

The UKIPO rejected the first group of arguments made by GAP Inc., stating that:
• Consumers do not separate the phrase “MIND THE GAP” into the individual elements “MIND THE” and “GAP,” which eliminates the possibility of confusion between TFL products and the GAP brand.
• There was no evidence that the registration of the trademark by TFL would give them an unfair advantage or that consumers could mistakenly perceive TFL products as being associated with GAP.

However, the UKIPO agreed with GAP Inc. regarding the issue of TFL’s bad faith. The Office agreed that TFL had violated a prior agreement by applying to register the trademark for certain products, namely wallets and handbags. Furthermore, Brexit did not invalidate the prior agreement, which remains in effect in the United Kingdom, and the alleged breach of the agreement by GAP Inc. did not give TFL the right to terminate it.

After decision

The UKIPO’s decision allowed TFL to register the “MIND THE GAP” trademark for most products in classes 9 and 18, with the exception of clothing accessories covered by a prior agreement between the parties.

The final costs of the case are to be the subject of a further ruling, as both parties requested that their costs be covered to a greater extent than the standard amount. GAP Inc. argued that TFL acted unreasonably in requesting evidence of the GAP brand’s reputation, which they claimed was a matter of common knowledge. The UKIPO stated that such requests could be grounds for awarding higher costs, even if the party responsible for these actions ultimately achieved partial success.

Consequences of decisions

The conflict between TFL and GAP Inc. demonstrates the importance of adhering to prior agreements and how nuanced the interpretation of trademarks can be. For GAP Inc., protecting its brand means not only fighting for its image but also ensuring fair competition.

At the same time, this decision highlights that registering trademarks requires diligence and consideration of prior agreements. The case may set an important precedent that will influence future conflicts regarding trademarks and their interpretation in the evolving legal and business environment.
