During a routine market check and review of trademark registers, IKEA discovered five trademark applications filed by IKEY. In response, the Swedish company sent a letter demanding that IKEY cease infringing on its trademark rights. However, IKEY refused to acknowledge any similarity between the trademarks.
IKEY sells building materials such as hardware, paints, glass, and plywood. The company’s website stated that it offered “a wide range of products from well-known brands.” IKEA argued that this could mislead consumers and suggest that IKEY sells IKEA products.
The Delhi Court issued an interim order that:
• restrains IKEY from using trademarks similar to IKEA;
• orders the suspension of the ikeyllp.com website domain for the duration of the proceedings;
• requires IKEY to disclose detailed information about the domain registration.
Since none of the parties representing IKEY appeared in court, the interim order was issued in favor of IKEA. The next hearing in the case is scheduled for May 9, 2025.
IKEA, as a global leader in the furniture industry, has a highly recognizable brand that requires effective protection in various markets. The similarity of names such as “IKEY” can mislead consumers, which negatively affects the reputation and trust in the original products of the Swedish company.
The IKEA versus IKEY case demonstrates how important it is to protect trademarks in the international market. Companies must monitor trademark applications and respond to potential infringements. At the same time, companies should avoid choosing trade names that may infringe on the rights of other brands in order to avoid costly legal disputes.
The Delhi court’s decision is a significant step in protecting IKEA’s interests in India. The interim injunction against IKEY using trademarks similar to IKEA demonstrates the importance of ensuring transparency and fairness in communication with consumers. The final resolution of the case, scheduled for May 2025, will be another important milestone in this matter.
